Why Should I Bother Appealing Against A Parking Ticket?

Since the days of legitimisation in 1990, appeals for parking tickets have shown a sharp increase from the motorists. This in turn has led majority of people to apply more and more for the appeals.

The fact is that if nobody is charged with parking tickets then there would be less chaos on the roads and then the local councils will have smaller budgets or they will be compelled to raise council taxes as there would be little or null revenues from parking fines.

This is the theory behind issuing a parking ticket and imposing parking fines for collecting transport revenues even if one does not breaks the law. Besides utilitzing this technique of photography evidence, one can also apply technical assistance. Common technicalities include doing things written on the parking ticket. For instance if the ticket says you were parked in Smith Street when in fact you were parked in smith road, then you can simply argue that the incident didn't even occur thus increasing the parking appeal more strongly and winning it.

A relatively new phenomenon is private parking tickets. You get a ticket in a similar fashion to what a traffic warden gives you. The ticket looks very similar to normal parking tickets. It will say something like "Parking Charge Notice pay within 14 days for a reduced rate. Non payment will result in us contacting the D.V.L.A. for your details."

Such tickets are not legally binding by any stretch of the imagination. You cannot appeal these tickets, and it is best to avoid contacting such companies. They will simply threaten you until you agree to pay, but they are reduced to such threats because they know they cannot legally force you to pay.

To make my point clear let me set an instance of one company called Euro car parks which according to my knowledge has never taken anyone to court for non payment of their parking fines. Thus it is to say that if any company does take you to court over non payment of parking fines then they would have to prove you as a registered keeper party to any contract (when you enter their car park you enter in to a contract). Clearly to state that they need to prove you were driving the car at that time. So even if they could prove it that you were driving the car at the given time, then they would impose you an amount of extra 2 pounds for an hours parking.

The moral here is to avoid paying such tickets even in the face of threatening letters. If you ignore such letters the company will cease to send them, though you do have the option of suing for harassment if it goes too far. That being said, don't make a payment on any ticket without checking with the Council.
